Terms and Conditions of Sale

These Terms and Conditions of Sale (“Conditions”) govern the purchase of a ticket for admission to Thermea Spa Village. These Conditions constitute an agreement between you and Thermea Spa Village Whitby Inc. (“Thermea Spa Village”). By purchasing a ticket for admission to Thermea Spa Village through its website or by telephone, you are agreeing to these Conditions.

Prices Displayed

Thermea Spa Village invoices in Canadian currency. All prices listed, unless otherwise stated, are shown in Canadian dollars (CAD) before taxes. Rates are subject to change without notice.

Thermea Spa Village reserves the right at any time to modify or discontinue any service (or any portion or content of any service) without notice and at any time. We will not be liable to you or any third party for any change in price, suspension or discontinuation of service.

Guarantee & Pre-authorization

A valid credit card must be used to guarantee your reservation at Thermea Spa Village. Thermea Spa Village reserves the right to cancel any reservation made with an invalid credit card.

On the day of a booking, Thermea Spa Village requires you to present a valid credit card for the purposes of placing a $150 pre-authorization charge on it per guest. Upon arrival at Thermea Spa Village, you will be issued a unique RFID bracelet to be used by you to make purchases during your visit to Thermea Spa Village. At the conclusion of your visit, the $150 pre-authorization will be adjusted automatically to take into account the purchases made on your RFID bracelet during your visit and you will be charged for the actual amount spent. If your $150 pre-authorization is reached during your visit, another pre-authorization for the same amount will be processed automatically on the same credit card.

Cancellation Policy

Cancellations must be requested by email at info.whitby@thermea.com.

Please keep in mind that: Reservations remain fully refundable to the original method of payment if cancelled at least 48h before the reservation time.

Cancellations made between 24h and 48h prior will be entitled to a full reservation credit in the form of a gift certificate that will be sent to the email address used for booking. The credit may then be applied to a future reservation. It is also possible to postpone a reservation to another date up to 24h before the original arrival time. Should you need to postpone or modify a reservation with less than a 24h notice, it may be requested by phone (9 a.m. to 9 p.m. on weekdays, or 9 a.m. to 5 p.m. on weekends) or via chat (8 a.m. to 9 p.m.) and will incur a rebooking fee.

Should you be denied entry following health screening questions, a credit in the form of a gift certificate for the value of your reservation will be provided.

Force Majeure

Thermea Spa Village will not be responsible for any delay or failure to perform its obligations under these Conditions or otherwise, which arise out of or is due to unforeseeable events independent of the intention of the parties such as but not limited to force majeur (“Force Majeur Events”), including, by way of example and not of limitation, all events of war, terrorist actions, interventions and prohibitions of official authorities, delays, inclement weather, lack of energy, financial crisis, labour conflicts, epidemics and pandemics.

Liability Limitation

All guests of Thermea Spa Village are required to sign a liability waiver releasing Thermea Spa Village for any loss, damage, accident, illness and other items as specified therein upon arrival at Thermea Spa Village. Any guest who declines to sign the liability waiver will be denied entry without refund or compensation.

Confidentiality

Thermea Spa Village is concerned about the privacy of its guests and undertakes to respect it. This policy has been formulated to inform all guests of Thermea Spa Village of its firm commitment to this effect. No personal information is collected or disclosed unless the prior consent of the user has been obtained voluntarily by writing directly to an email address mentioned on our website, participating in a promotion, registering for a service, creating a profile, or in any other similar way.

Conformity

In order to safely provide guests with the requested services, Thermea Spa Village reserves the right to ask its guests to provide personal information or supporting documents if and when necessary.

Electronic Tickets and Resale

Illegal resale of any ticket of admission is strictly prohibited and can result in the cancellation of the purchase without refund or compensation. Admission tickets are not transferable nor exchangeable for money and are only valid for the date and time selected during the booking process.

Promotional Use Prohibited Without Permission

Without prior written authorization from Thermea Spa Village, admission tickets cannot be sold or used for advertising and/or promotional purposes (including contests and lotteries).

Photographs & Social Content

Photographs, films or social media of any kind content taken at Thermea Spa Village cannot be used for any commercial purposes without prior official written consent from Thermea Spa Village. Thermea Spa Village reserves the right to seek compensation for any use which is contrary to these Conditions.

Eligibility

You must be at least 19 years of age to access Thermea Spa Village. All guests of Thermea Spa Village must present a valid piece of government issued identification for admission.

All guests are required to sign a liability waiver releasing Thermea Spa Village upon arrival at Thermea Spa Village. Any guest who declines to sign the liability waiver will be denied entry without refund or compensation.

The thermal experience is not recommended for people with heart problems, hypertension, breathing problems, angina, high-risk pregnancy or diabetes.

Guests of Thermea Spa Village are strictly prohibited from bringing in, or consuming, outside food, alcohol, or illegal substances. To ensure the safety and wellbeing of Thermea Spa Village guests, the consumption of any forms of tobacco or cannabis are prohibited at Thermea Spa Village.

Thermea Spa Village reserves the right to inspect the bags and/or lockers of its visitors.

Refusal of Access & Expulsion

Thermea Spa Village reserves the right to refuse access or expel any guest whom it considers is acting against its code of ethics, values, or behavioural etiquette. Interactions at Thermea Spa Village, including Thermea Spa Village social media platforms/sites, must be carried out in a respectful, harmonious, and courteous manner. . Insulting, threatening, or harassing another guest or employee is prohibited. Thermea Spa Village maintains a zero tolerance policy with respect to , defamatory, indecent, hateful, racist, xenophobic, homophobic, sexist, vulgar, or discourteous statements or any other violent act.

Modification of Conditions

Thermea Spa Village reserves the right to modify these Conditions and its cancellation policy at any time. The last revision of these Conditions is displayed at the bottom of this page.

These Conditions constitute an agreement between you and Thermea Spa Village Whitby Inc. (“Thermea Spa Village”). By purchasing an online gift certificate from Thermea Spa Village through the Thermea Spa Village website or by telephone, you are agreeing to these Conditions.

Prices Displayed

Thermea Spa Village invoices in Canadian currency. All prices listed, unless otherwise stated, are shown in Canadian dollars (CAD) before taxes. Online gift certificates purchased are final sales and non-refundable. An online gift certificate may not be purchased with a previously purchased online gift certificate.

Rates are subject to change without notice. In the event of a price increase, the difference must be supplemented for the desired service.

Expiration of Online Gift Certificates

The monetary value of an online gift certificate is always valid and does not expire. Its value can be applied to any type of reservation until the balance of the initial gift certificate has been fully used.

Using an Online Gift Certificate

An online gift certificate purchase does not guarantee a reservation. It acts as a payment method towards a reservation. Reservations are required and the conditions of sale associated to these must be respected. For security reasons and to prevent fraud, online gift certificates may only be used 48 hours after the date of purchase.

Shipping Gift Certificates

Gift certificates are shipped as soon as possible once the order has been processed. The processing and delivery times vary depending on the delivery address. Thermea Spa Village parcels are shipped via Canada Post.

Thermea Spa Village reserves the right to modify the shipping costs of its gift certificates at any time and without notice. All shipping fees are in Canadian dollars. The sales tax is calculated based on the province of the spa. Thermea Spa Village cannot guarantee delivery of gift certificates to addresses outside of Canada.

Online Gift Certificate Resale

Illegal resale of any online gift certificate of admission is strictly prohibited and can result in the cancellation of the purchase without refund or compensation.

Promotional Use Prohibited Without Permission

Without prior written authorization from Thermea Spa Village, online gift certificates cannot be used for advertising and/or promotional purposes (including contests and lotteries). Promotional use without permission can result in the cancellation of the purchase without refund or compensation.

Privacy Policy

No personal information will be disclosed to anyone except during the transactional process of obtaining authorization from the credit card issuer or as required by law.
